These Terms of Service ("Terms") govern your use of the Battista Academy funnel, assessment, and related pages and offerings (the "Service"), operated by Battista Academy ("we," "us," or "our"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Service provides a business self-assessment, educational content, and the opportunity to schedule a consultation. Submitting the assessment does not create any client, advisory, or fiduciary relationship.

2. Eligibility

You must be at least 18 years old and authorized to provide the business and contact information you submit.

3. No guarantee of results / earnings disclaimer

Any results, figures, case studies, or testimonials are examples and are not promises or guarantees of future performance. Business outcomes depend on many factors outside our control, including your effort, market conditions, and execution. We do not guarantee any specific revenue, profit, or other result. Nothing on the Service is financial, legal, tax, or investment advice; consult a qualified professional before making decisions.

4. Communications consent

By submitting your information and checking the consent box, you agree to be contacted by email, SMS/text, and phone (including automated and pre-recorded messages) as described in our Privacy Policy. Consent is not a condition of purchase. You may opt out at any time (reply STOP to texts).

5. Acceptable use

• Do not submit false information or another person's information without authorization.
• Do not attempt to disrupt, probe, or gain unauthorized access to the Service or its systems.
• Do not use automated means to submit forms or scrape the Service.

6. Intellectual property

The Service and its content, including text, graphics, videos, and the assessment methodology, are owned by Battista Academy or its licensors and are protected by law. You may not copy, reproduce, or create derivative works without our written permission.

7. Third-party services and links

The Service relies on third-party providers (including GoHighLevel, Meta, PostHog, Wistia, and Vercel) and may link to third-party sites. We are not responsible for the content or practices of third parties.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, Battista Academy and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim will not exceed one hundred U.S. dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless Battista Academy from claims arising out of your misuse of the Service or violation of these Terms.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Virginia.

12. Changes

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.
